MILAN, Oct 14 (Reuters) -Intesa Sanpaolo ISP.MI is under investigation by prosecutors in Italy after a former employee of the country's biggest bank illegally spied on account data of thousands of its customers, Italian news agency ANSA reported on Monday.
Intesa said in a statement it had received no formal notice of having being put under investigation. Prosecutors in the southeastern town of Bari who arelooking into the data breach declined to comment about the report.
The prosecutors opened an inquiry into the incident after Intesa, which first suspended and then fired the employee on uncovering the security lapse, alerted Italy's data protection authority and filed a complaint asan injured party.
Intesa said it had been able to alert the authorities only once "an extended and accurate analysis provided it with a clear picture of the events".
On Sunday, the bank publicly apologised after it emerged that the accounts of around 3,500 customers, including Prime Minister Giorgia Meloni and former Prime Minister Mario Draghi, might have been violated.
The name of the sacked employee has not been given and it is not clear why the person accessed the accounts.
Prosecutors in Bari first investigated the former employee for abusive access to computer systems and attempted theft of information concerning state security.
They are now alsolooking into whether Intesa failed to alert the authorities promptlyonce it uncovered the apparent breach, ANSA said.
Under Italian law, a company can be held liable for a number of alleged offences committed by its staff. However, being placedunder investigation does not necessarily mean it will lead to charges or eventual trial.
While the employee had permission to access current account data, given their role within the bank, Intesa's internal control system detected an excessive number of data requests, triggering an internal inquiry, a person with knowledge of the matter told Reuters.
"Once the internal control system flagged the anomalies, the bank immediately started the disciplinary procedure and the long and complex assessment," Intesa said.
In saying it was "deeply sorry" for what had happened, Intesa on Sunday said there had been no cybersecurity problem.
The Bank of Italy separately said it had asked Intesa to provide details about the situation and explain the measures it now planned to take.
"National and European supervisions constantly monitor banks' IT and cyber risks, asking lenders to strengthen their checks. ... This cannot always prevent the misconduct of single individuals," the central bank said.
Following news of the investigation, lawyers for some of the customers who were allegedly spied upon requested information from the prosecutors ahead of possible lawsuits for damages, ANSA reported.
Meloni herself acknowledged the incident in an interview at the weekend with news programme TG5, saying she expected the judiciary to investigate what had happened.
